These Terms of Service ("Terms") govern your use of the website at https://rabbithole.rs (the "Site") and your participation in any immersive entertainment experiences provided by Rabbit Hole Recreation Services, Limited ("the Company," "we," "us," or "our"). By booking a game, entering our facility, or using our Site, you agree to be bound by these Terms. If you do not agree, please discontinue use of our Site and services.
1. Scope of Agreement
These Terms apply to all participants ("Participants," "you," or "your") and visitors to our facility located in Louisville, Colorado. This agreement includes our rules for participation, booking and cancellation policies, and a release of liability.
2. Participation and Age Requirements
- Minors (Under 18): All participants under the age of 18 must have a liability waiver signed by a parent or legal guardian.
- Adult Supervision: Participants under the age of 13 must be accompanied inside the game room by at least one adult (18+).
- Unaccompanied Minors: Players aged 12 and above may participate without an adult present in the room, provided a parent or guardian remains on the premises for the duration of the experience.
3. Booking, Pricing, and Payments
- Private Bookings: All reservations at Rabbit Hole are private. We do not pair your group with strangers.
- Tiered Pricing:
- 2 Players: $45.00 per person
- 3 Players: $40.00 per person
- 4+ Players: $35.00 per person
- Payment: Full payment is required at the time of booking to secure your reservation.
4. Cancellation and Rescheduling Policy
- No Refunds: All purchases are final and non-refundable.
- Rescheduling: You may reschedule your game for a future date at no additional cost if you provide notice at least 24 hours prior to your scheduled start time.
- No-Shows: "No-shows" are defined as participants who do not attend their reservation or who attempt to reschedule with less than 24 hours' notice. No-shows are not eligible for refunds or rescheduling.
- Late Arrivals: We require all groups to arrive 15 minutes prior to their scheduled start time for check-in and briefing. If your group is late, the time will be deducted from your 60-minute game clock. Groups arriving more than 15 minutes late may have their game cancelled without a refund.
5. Participant Conduct and Safety
- Intoxication: We reserve the right to refuse entry to any individual who appears intoxicated or under the influence of drugs. No refunds will be issued in these cases.
- Physical Force: Our puzzles are designed for rational solutions through deduction. The use of excessive force, climbing on walls, or tampering with electrical/fire systems is strictly prohibited.
- Prohibited Items: Cell phones, cameras, recording devices, outside food/drink, and weapons are not permitted inside the escape rooms.
- Property Damage: Participants are responsible for any damage caused to the facility, props, or equipment due to intentional misuse or negligence. The Company reserves the right to charge the credit card on file for actual repair or replacement costs.
6. Release of Liability and Assumption of Risk
PLEASE READ CAREFULLY. THIS SECTION LIMITS YOUR LEGAL RIGHTS.
By participating in our experiences, you acknowledge that escape rooms involve inherent risks, including but not limited to: movement in dimly lit or confined spaces, interaction with mechanical props, and potential mental stress or anxiety.
- Waiver of Negligence: To the fullest extent permitted by Colorado law (including the standards set in Jones v. Dressel), you hereby release Rabbit Hole Recreation Services from any and all claims of ordinary negligence arising out of your participation.
- Parental Waiver: In accordance with C.R.S. § 13-22-107, parents or legal guardians signing on behalf of a minor acknowledge their fundamental right to make decisions regarding the risks their child assumes and voluntarily waive the child’s prospective claims for ordinary negligence.
- Exceptions: This release does not apply to claims arising from gross negligence, willful or wanton misconduct, or intentional fault.
7. Intellectual Property and Non-Disclosure
- Non-Disclosure: You agree not to disclose game solutions, "spoilers," or proprietary game mechanics to the public.
- Media Release: You grant the Company permission to use any photographs taken of your team by our staff for promotional purposes on our website or social media, unless you explicitly opt out at the time of the photo.
8. Electronic Communications (SMS)
By providing your phone number during booking, you agree to our SMS Terms as outlined in our Privacy Policy. You may receive booking reminders, alerts, or marketing promotions. You can opt out at any time by replying STOP.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado. Any disputes arising from these Terms or your participation shall be resolved in the courts of Boulder County, Colorado.
